By accessing and using this appointment management service (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Our Service provides a comprehensive appointment management business management platform that includes:

  • Calendar and Appointment Management: Schedule, manage, and track appointment management appointments
  • Client Management: Store and manage client information, service history, and communications
  • Service Documentation: Create and manage service logs, treatment plans, and appointment management reports
  • Employee Management: Track employee locations, schedules, and performance
  • Route Optimization: Optimize service routes for efficiency
  • Email Automation: Automated reminder and notification systems
  • Analytics and Reporting: Business analytics, logs, and performance metrics
  • Multi-Service Support: Pest control, cleaning, electrical, HVAC, lawn care, and plumbing services
  • Mobile Access: Progressive web app functionality for field operations

3. User Responsibilities

3.1 Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

3.2 Data Accuracy

  • You are responsible for the accuracy of all data entered into the Service
  • You must ensure client information is collected and used in compliance with applicable laws
  • You must maintain proper consent for collecting and storing client data

3.3 Legal Compliance

  • You must comply with all applicable local, state, and federal laws
  • You are responsible for obtaining necessary licenses and permits for appointment management operations
  • You must follow all safety regulations and industry standards

4. Subscription and Payment Terms

4.1 Subscription Plans

  • Various subscription tiers are available with different feature sets and limitations
  • Subscription limits apply to the number of clients, appointments, and users
  • Subscription features may change with notice

4.2 Payment

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as expressly provided in these terms
  • Price changes will be communicated with at least 30 days notice

4.3 Service Suspension

  • We may suspend service for non-payment after reasonable notice
  • Data access may be limited during suspension periods

5. Data and Privacy

5.1 Data Ownership

  • You retain ownership of all data you input into the Service
  • We provide tools for data export and backup
  • You are responsible for maintaining your own data backups

5.2 Data Security

  • We implement industry-standard security measures to protect your data
  • Data is encrypted in transit and at rest
  • We maintain logs for security and compliance purposes

5.3 Third-Party Integrations

  • The Service integrates with third-party platforms including QuickBooks (Intuit Inc.) and Xero. We are not affiliated with, endorsed by, or sponsored by Intuit or Xero.
  • You are responsible for your own compliance with the terms of service of any third-party platform you connect to our Service.
  • QuickBooks and Xero data accessed through integrations is used solely to provide invoicing functionality within the Service and is not shared with other parties.
  • You may disconnect third-party integrations at any time through your account settings, after which we will delete any stored integration tokens.

5.4 Location Data

  • The Service may collect employee location data for route optimization and time tracking
  • Location tracking requires explicit consent from employees
  • Location data is used solely for business operation purposes

6. Service Availability

6.1 Uptime

  • We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We are not liable for downtime due to factors beyond our control

6.2 Data Backup

  • We provide automated backup systems for data protection
  • Backup retention periods vary by subscription level
  • Users are encouraged to maintain their own backup copies

7. Intellectual Property

7.1 Service IP

  • The Service, including all software, designs, and documentation, is our intellectual property
  • You receive a limited, non-exclusive license to use the Service
  • You may not reverse engineer, copy, or create derivative works

7.2 User Content

  • You retain ownership of content you create using the Service
  • You grant us a license to host, store, and process your content to provide the Service

8. Prohibited Uses

You may not use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or attempt to breach security
  • Use the Service for any fraudulent or deceptive purposes
  • Store or transmit inappropriate or harmful content

9. Limitation of Liability

  • We are not responsible for business decisions made using the Service
  • We do not guarantee the accuracy of route optimization or scheduling suggestions

9.2 Liability Cap

  • Our total liability is limited to the amount paid for the Service in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • Some jurisdictions may not allow these limitations

10. Termination

10.1 Termination by User

  • You may terminate your account at any time
  • Data export tools are available during the termination process
  • Subscription refunds are subject to our refund policy

10.2 Termination by Us

  • We may terminate accounts for violation of these terms
  • We may discontinue the Service with reasonable notice
  • Data will be available for export for a reasonable period after termination

11. Modifications

We reserve the right to modify these terms at any time. Changes will be effective upon posting to the Service. Continued use constitutes acceptance of modified terms.

These terms are governed by the laws of the State of California without regard to conflict of law provisions.
